Welcome to Always Better Care. These Terms and Conditions ("Terms") govern your use of our website and services. By accessing or using our website at alwaysbettercares.com or engaging our home care services, you agree to be bound by these Terms. Please read them carefully.

1. Acceptance of Terms

By using this website or our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our website or services.

2. About Our Services

Always Better Care is a licensed home health care agency (License Number: 299996599) operating in Florida. We provide non-medical home care services including:

  • Personal care assistance
  • Companion care
  • Post-surgical assistance (non-medical)
  • Alzheimer's and dementia support
  • Respite care
  • Transportation services

Our services are non-medical in nature and do not include skilled nursing care, medication administration, or medical procedures that require licensure.

3. Service Agreement

Before services begin, clients will receive a separate Service Agreement that outlines:

  • Specific services to be provided
  • Schedule and hours of care
  • Rates and payment terms
  • Care plan details
  • Cancellation and termination policies

The Service Agreement, together with these Terms, constitutes the complete agreement between the client and Always Better Care.

4. Eligibility and Consent

You must be at least 18 years of age to enter into a service agreement with us. If you are arranging care for another person, you represent that you have the legal authority to do so and have obtained all necessary consents.

5. Payment Terms

Always Better Care operates on a private pay basis. Payment terms include:

  • Rates are based on the level of care and hours of service required
  • Payment is due according to the schedule outlined in your Service Agreement
  • Late payments may be subject to late fees as permitted by Florida law
  • We do not currently bill insurance or Medicare/Medicaid

6. Cancellation and Rescheduling

Cancellation and rescheduling policies will be detailed in your Service Agreement. Generally, we require advance notice for cancellations or changes to scheduled care visits. Failure to provide adequate notice may result in charges for scheduled services.

7. Caregiver Qualifications

All Always Better Care caregivers undergo comprehensive background checks (Level 2 screening in accordance with Florida law), are properly trained, and are fully insured and bonded. We comply with all requirements of the Florida Agency for Health Care Administration (AHCA).

8. Client Responsibilities

Clients and their families agree to:

  • Provide accurate and complete information about care needs
  • Maintain a safe working environment for caregivers
  • Inform us promptly of any changes in condition or care needs
  • Treat caregivers with respect and dignity
  • Provide timely payment according to the Service Agreement
  • Not independently hire our caregivers during or after service

9. Limitation of Services

Always Better Care does NOT provide:

  • Medical care or skilled nursing services
  • Medication administration (medication reminders only)
  • Medical diagnoses or treatment
  • Heavy lifting or tasks that could endanger caregiver safety
  • Services outside the scope of our license

10. Limitation of Liability

To the fullest extent permitted by law, Always Better Care's liability is limited to the amount paid for services during the period in which the incident occurred. We are not liable for indirect, incidental, consequential, or punitive damages. This limitation does not apply to cases of gross negligence or willful misconduct.

11. Indemnification

You agree to indemnify and hold harmless Always Better Care, its owners, employees, and agents from any claims, damages, or expenses arising from your breach of these Terms or misuse of our services.

12. Website Use

When using our website, you agree to:

  • Not use the website for any unlawful purpose
  • Not attempt to gain unauthorized access to our systems
  • Not transmit viruses, malware, or harmful code
  • Not collect information about other users
  • Respect all intellectual property rights

13. Intellectual Property

All content on this website, including text, graphics, logos, images, and software, is the property of Always Better Care and is protected by U.S. copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our express written permission.

14. Privacy and Data Protection

We are committed to protecting your privacy. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. We comply with all applicable federal and Florida privacy laws, including HIPAA where applicable.

16. Disclaimer of Warranties

Our website and information are provided "as is" without warranties of any kind, either express or implied. We do not warrant that the website will be uninterrupted, error-free, or free from viruses or other harmful components.

17. Dispute Resolution

Any disputes arising from these Terms or our services will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, to be held in Orange County, Florida. You waive the right to participate in class action lawsuits.

18. Governing Law

These Terms are governed by the laws of the State of Florida and the United States, without regard to conflict of law provisions. Any legal action must be brought in the courts of Orange County, Florida.

19. Force Majeure

Always Better Care shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, pandemics, epidemics, government orders, labor disputes, or utility failures. In such events, our performance obligations shall be suspended for the duration of such circumstances.

20. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms to any affiliated entity or in connection with a merger, acquisition, or sale of assets, upon notice to you.

21. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of any provision of these Terms will be effective only if in writing and signed by Always Better Care.

22. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

23. No Agency Relationship

Nothing in these Terms creates a joint venture, partnership, employment, or agency relationship between you and Always Better Care. Our caregivers are employees or contractors of Always Better Care, not of the client.

24. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.
